A:The customer pays the sales tax. Taxes that the business owner would pay is usually figured into the cost of the product to be sold, so technically, the consumer pays again. In California, if you carry a product inventory, you will get hit for an inventory tax, but that occurs mostly for those with a brick and mortar type business (dress shop, bookstore, sporting goods, etc). Then you have your income taxes and whatnot. But if you take all your allowable deductions, figure in your depreciation's, ect., then what you are actually paying in taxes can be minimal. A good CPA/tax advisor can give you a wealth of information.

Printing Company I buy Paper at a whosale price sell it for retail to Customers. I also charge labor, typesetting, and other fees necessary. Taxation code 6094.5 I just don't understand if I just charge for mark up on paper or, charge for the total services rendered.

A:California sales tax on printing can be kind of complicated. Most of your charges are going to be subject to tax, but some might not be. You should read the regulation referenced below that applies specifically to printers. http://www.boe.ca.gov/pdf/reg1541.pdf I'm not sure why you reference 6094.5. It refers to a penalty you can be charged if you knowingly issue a resale certificate for products you are not going to resell.

I don't have Realtor- friend and this transaction is for sale by owner.
